7/11/1835, Vol 1, No 38-Mr. RICHARD WARREN died on the 3rd Inst, in the 72nd
Year of his age".

Richard Warren served in the Revolutionary War from Wilmington District, NC-(pay voucher) Wilmington District included Onslow Co.
The Warren family removed to Burke Co., Ga. about 1785, where Richard resided for several years;
removed to Miss. Territory about 1803, and then to Conecuh Co, Ala about 1816* where he built Fort Warren,
Pine Orchard Community, near Burnt Corn** for the protection of the settlers, and travelers on the Old Federal
Road. Many
settlers from Conecuh & Monroe Counties took refuge in this fort during the many Indian
uprisings
*Territory of Alabama was created from Eastern half of Mississippi Territory on
March 3, 1817, with St. Stephens as the Capitol; In Nov, 1818 Cahaba was made
the Capitol; and in 1819 became a state with temp. Capitol at Huntsville
**-Burnt Corn & Pine Orchard Communities are divided by the county line (Old Federal Road) between Conecuh & Monroe Counties. One side of the road is in Monroe Co, and the other side is in Conecuh Co.
"In 1817 the first court house of the
county was built on Hampdon Ridge. By mutual agreement between the whites and
the Indians, whose camps and villages lay beyond Murder creek, this stream was
fixed as a boundary. But, due to increased Indian attacks on the white
settlers, the settlers organized and drove the Indians out. Richard Warren was
the first white
settler to venture across Murder Creek to build his home. He was
soon after followed by his son, (Hinchey) who located at the point where he
died, one mile east of Sparta.
In 1820 the Warrens, along with the Hunters & Boykins, were responsible for
the court house being removed from Hampdon Ridge across the creek, where a new
courthouse was built, and the village was given the name of Sparta. After the
removal of the court house, the bar of Conecuh was increased by the location of
Samuel W. Oliver, Edridge S. Greening, and John S. Hunter, at Sparta."

Rites Held For Henry Warren
Henry D. Warren 64 of Glenwood died in a Troy hospital yesterday. Funeral services were held at 2 p.m. today from the Fleetwood Baptist Church. Burial followed in Hopewell Cemetery with Turner's Funeral Home in charge.
Survivors include the widow Mrs. Lillie Warren; four daughters, Mrs. J. F. Elliott, Montgomery; Mrs. C. M. Godwin, Columbus, Ga.; Mrs. Mancil Schofield, Macon, Ga. and Mrs. Peek Stephens, Glenwood; and two sons, Joel D. Warren, U. S. Army and Cyril Warren, Glenwood.

Butler County
Whereas, William H. Caldwell, lately of the
County of Wilcox , now deceased, did in his lifetime on the 24th day of
December, 1834, for and in consideration of the sum of Five Hundred Dollars,
to him
in hand paid at the time aforesaid , grant, bargain, sell , and convey to
Hubbel Pierce then of the town of Greenville and county of Butler, a certain
tract or parcel of land known and designated on the East half of the SW 1/4 of
Section 3, township 12 and Range 16, containing 82 12/100 acres lying and
situate in the County of Lowndes in State aforesaid and belonging to the
District of lands sold at Cahaba, known further as the place called Pierces Hill
upon which is a dwelling house, lately occupied by Edward N. Pierce and whereas
the said William H. Caldwell at the time of the sale of the said land did
execute and deliver to the said Hubbel Pierce a bond with two securities,
to wit: John C. Caldwell and John C. Pickens obligating himself to make to the
said Hubbel Pierce a good and lawful fee simple deed to same on the patent
therefore should be secured from the United States General Land Office and
whereas the said Hubbel Pierce to whom the said the fee simple title was to be
made did on the 25th day of February, 1838 transfer and convey to Ezekiel H.
Pickens all the rights, title, claim, and interest which he had and holds to
said tract or parcel of land.
Now know ye, that I, Robert Warren of the County of Wilcox and State aforesaid,
who has been duly appointed by the Judge of the Orphan's Court of Wilcox County,
Administrator of all and singular the goods? and chattels. rights and credits of
the said William H. Caldwell, dec'd., in community with the obligations made and
delivered as aforesaid do hereby grant, bargain, sell and convey to the said
Ezekiel H. Pickens, his heirs and assigns the said tract or parcel of land
herein before named and described and together with all buildings thereon and
all the improvements and appurtenances thereunto appertaining and belonging , to
have and to hold the said tract or parcel with the improvements aforesaid to the
said Ezekiel H. Pickens, his heirs and assigns forever in fee simple; And I, the
said Robert Warren do hereby covenant and agree to defend the rights and title
of the said Ezekiel H. Pickens to the said tract or parcel of land against the
claims, demands of all persons whatsoever. In witness whereof, I ,
the said Robert Warren, Administrator as aforesaid, have on this 11th day of
January, 1839, hereto set my hand and affixed my seal .

This indenture made and entered into this the
22nd day of August, in the year of our Lord, one thousand eight hundred and
thirty-nine, between Robert Warren and Mildred Warren, wife of the said Robert
Warren, of the first part and Solomon Smith of the second part, all of the
County of Wilcox, State of Alabama witnesseth that the said Robert Warren and
Mildred, his wife, of the first part aforesaid, and in consideration of the sum
of fourteen hundred dollars to this in hand paid by the said Solomon smith, of
the second part, as aforesaid at and before the unsealing and delivery of these
presents hereof the receipt whereof is hereby acknowledged, have granted,
bargained, sold and conveyed and confirmed and by these presents do grant, sell
convey and confirm unto the said Solomon Smith and to his heirs and assigns,
forever, all the following described lots, tracts, or parcels of land to wit:
The North of the N E quarter of Section 26, of T/S 12, of Range 9, containing 78
acres and 37 1/2 hundreths of an acre more or less also the South half of the SE
quarter of Section 3, of T/S 12, of Range 9, ; also the SE quarter of the SW
quarter of Sect. 23, T/S 12, Range 9, containing 39 acres and 19 hundreths of an
acre, more or less; and also the NE quarter of the SW quarter of Sect. 23, T/S
12, Range 9, containing 39 and 19 hundreths of an acre, more or less; all of the
foregoing described lots or tracts of land situated, lying, being in the county
of Wilcox, State of Alabama, of the District of land sold at Cahaba, to have and
to hold all and singular the described lots, tracts, or parcels of land, to him,
the said Solomon smith, and to his heirs, executors, Administrators or assigns,
in fee simple forever; together, with all and singular the improvements and
appurtenances thereto belonging or in any wise appertaining to his and their own
proper use, benefit and behoof and we, the said Robert Warren and Mildred
Warren, his wife, do covenant and agree to and with the said Solomon Smith, that
we will ___our heirs, Exrs. or Admrs. forever warrant and defend the right and
title of the above described land to the said Solomon Smith and to his heirs and
assigns against the quit claim of all and every other persons lawfully claiming
said land. In witness whereof we have hereunto set our hands and

"Malachi Warren built
a log cabin on the spot where afterwards stood the Rankin House. This cabin was
the first building erected upon the site of old Sparta. From here Malachi
Warren operated a place of business that might be aptly described as a pop-corn
grocery. Between the homes of Major Warren and his son Hinchey, a
gentleman by the name of Spires located. In 1819 Thomas Watts, Uncle to Ex-Gov.
Watts, removed from Georgia and settled near Malachi Warren's house."
Will of Malachi Warren, Lowndes Co., Ala, dated 16 July, 1862 Proved Lowndes Co,

I. Malachi Warren, now of Lowndes Co, State of Alabama, being of sound disposing
mind and memory, In the Name of God, Amen; do hereby make, ordain and publish
this my last Will and Testament, hereby revoking all other wills at any time
heretofore made by me.
First, I do hereby give and bequeath unto my
well beloved niece, Elizabeth Robinson, wife of George Robinson of Polk Co.,
Texas, (Robison)** the following described and named Negroes, to Wit: Henry Ragan, a
Negro man about 20 yrs of age, Martha, a girl about 17 yrs of age, and her
child; also George, a man about 25 yrs of age, Henrietta, a girl aged about 16
yrs, Mariah, a girl aged about 19 yrs, Louis, a man aged about 22 yrs, children,
to wit: Sidney, a boy, and Belle, a girl, also Kate, a girl, aged about 11 yrs.
and John, a boy, aged about 16 yrs, to have and hold said Negro slaves and their
future increase to the sole and separate use of her, the said Elizabeth, for and
during the term of her natural life, and at her death, to her children
forever.
Second, I give and bequeath unto my well beloved niece, Isabella Tennison, wife
of William Tennison, of Dallas County, Alabama, the following named and
described slaves, to wit: Marion, a mulatto boy, aged about 14 yrs, also Jesse,
a Negro boy, aged about 16 yrs, and Washington, a man about 22 yrs of age, to
have and to hold the said Negro slaves, together with their future increase, to
the sole and separate use of her, the said Isabella, for and during her natural
life and at her death, to her children forever.
Third, I give and bequeath unto my beloved nephew, Malachi Warren, Jr., son of
Henry Warren of Pike Co., Alabama, all my money and all the notes, bills and
bonds, I hold in the State of Alabama, and whereas, I own the following named
and described notes: VIZ: (1) In the sum of $2,562.50 due December
16, 1861, (2) Also, one for $2,583.33 due January 16, 1862 (3) One for
$3,125.00 due February 16, 1862, and (4) one for $2,186.40 due March 16, 1862
all signed by Allen Copp & Nesbit, and now in the hands of A. G. Lowery of
St Louis, Missouri, and payable to him and for the collection of which, I have
given a written Power of Attorney, to B. W Lynch of St Louis, Missouri, in which
said Power of Attorney together with a written contract and agreement between
myself and said Lowery, are on record in the proper office of St. Louis,
Missouri. Now, when said notes are collected, if not otherwise
appropriated, I give and bequeath unto my said nephew, Malachi Warren, Jr,
and also the balance and remainder of notes and sums due to me in Missouri, if
living at the time when said notes are collected, and in case the said Malachi
Warren should be dead, then the proceeds to descend to the legal heirs which are
then living.
Fourth, I hereby nominate and appoint my sincere and trusty friends, David T.
McCall, and Tristan B. McCall, Executors of this my last Will and
Testament, and having all and every confidence in them, it is my expressed will
and discretion that no bond shall be taken or required of them by the Judge of
the Probate Court of Lownes or any other court or authority to execute this my
said will, but that they be fully authorized to execute the same without bond,
and that the same be by them probated and executed in Lowndes Co.,
Alabama.
And I do hereby authorize the said David McCall and Tristan B. McCall or either
of them in case George Robinson or his wife Elizabeth Robinson should visit
Lowndes Co during my absence at time from said County, to deliver to them or
either of them, the slaves named and described in the first part of this my last
Will and bequest to said Elizabeth by him on her giving a receipt for the same.
In witness whereof, I have hereunto set my hand and placed my signature this the
sixteenth day of July, AD, 1862.

deceased :
Before me, James W. Graham, Judge of the said
Court, personally appeared in open court, John J. McCaw, who having been by me
first duly sworn and examined, did and does dispose and say on oath, that he is
a subscribing witness to the Instrument of Writing, now shown to him, and which
purports to be the last Will and Testament of Malachi Warren, dec'd late,
and inhabitant of this county, that said Malachi Warren signed and executed said

for an in consideration of five hundred and seventy dollars to me in hand paid
by Archibald Tyson of the same county and state, the receipt I do hereby
acknowledge, have bargained, sold and conveyed unto said Tyson, a certain tract
or parcel of land to wit:
the South West quarter of the North West quarter and the North West quarter of
the South West quarter of Section fifteen (15) Township 13, of Range 14,
containing eighty acres more or less to have and to hold, I the said Malachi
Warren do for the above named sum warrant and defend the title of the above
named parcels of land unto the said Archibald Tyson to be free and clear from
all lawful claims whatsoever.

"Died--after a protracted illness, near Monterey, in Butler County, Ala., on Tuesday the 22nd of May, 1860, MRS. FRANCES E. YELDELL, wife of Robert Yeldell, and only daughter of James and Mary Powers, in the 30th year of her age. She left three small children--all sons--the oldest of which is about 10 years of age, the next six, and an infant about six weeks old, a grief-stricken and disconsolate husband, with numerous relations and friends, to mourn their irreparable loss.
Though she made no profession of Christianity prior to her illness, she died like a Christian. In her last moments she gave unmistakable evidence of a hope beyond the grave, and admonished her friends to meet her in heaven. Though many tears have been shed for her, "we sorrow not as those who have no hope," being assured that "all things work together for good to them that love God." Lamented and beloved we bid her sadly farewell."

In grief to weep and mourn,
But not as the disconsolate
Who put no trust in God.
Thy body we have laid beneath
The cold and silent sod,
But thou art not there, dear Fanny,
Thy spirit rests with God.
When her life was well nigh closing

Know all Men by these presents, that I, Laban Warren of the County of Lowndes and State of Alabama, for and in consideration of the sum of five hundred dollars to me in hand paid by John Rudolph & Burwell B. Rudolph, the right thereof I do hereby acknowledge, do hereby give, grant, bargain, sell enf___ and confirm unto the said John Rudolph & Burwell D. Rudolph, the following described tract or parcel of land, to wit:
The South East quarter of Section two (2); also the South East quarter of North East quarter and South East quarter of North West quarter Section eleven (11) , also the North East quarter of the North East quarter, Section eleven (11). Also, the North East quarter of the North West quarter, Section eleven (11); also the West half North East quarter, Section eleven (11), all of said lands in Township thirteen (13), of Range thirteen (13), containing in the whole four hundred and two acres, be the same, more or less, subject to sale at Cahaba, Alabama, together with all and singular the lands, tenements, and herediments thereunto appurtenances, to have and to hold the aforegranted premises to the said John Rudolph and Burwell Rudolph, their heirs and assigns to their use and behoof forever, and I do covenant with the said John Rudolph and Burwell Rudolph, their heirs, and assigns that i am lawfully seized in fee of the aforegranted premises that they are free of all incumbrances, that I have a good right to sell and convey the land to the said John Rudolph and Burwell Rudolph, their heirs and assigns and that I will warrant and defend the said premises to the said John Rudolph and Burwell B. Rudolph , their heirs and assigns forever against the lawful claims and demands all forever.

Mrs. J. W. George Dead.
Mrs. J. W. George died at her home in Catherine on Sunday night,
October the Second of Billious fever. Mrs. George was a Miss (Rebecca J)
Bussey, sister of Mr. R. H. Bussey of Walnut Bluff and Mrs. Sallie H.
Bragg of Auburn. She was a lady of fine traits of character, and was
loved for her gentleness and charity to weak humanity. In her home she
was cheerful, and her hospitality was known to all, and in the daily
walks of life she followed the Golden Rule in its entirety; "Unto all
such the doors shall be opened." She is survived by a husband, Mr. J.
W. George, and two daughters, Mrs. Joe Lambert and Miss Virgie George,
all of Catherine.

NO. 233-RICHARD WARREN:
With the notice of this claim is filed a plat of survey by Stephen Justice,
dated 13th March, 1803, and certified to have been made by the order of
Joseph Vidal, &c. The testimony of John Welch and Samuel Tanner, taken
by Benjamin Howard and Robert Scofield, Justices of the Peace in the Mississippi
Territory, under a commission from the board, is to the following purpose:
John Welch hath deposed that RICHARD WARREN, a man over twenty-one years of age,
and the head of a family, was, to his knowledge, inhabiting and cultivating a
tract of land on the waters of Tensaw, by the permission of Joseph Vidal, in
March, 1803, and that he continued to inhabit and cultivate the same for three
years thereafter. Samuel Tanner states, that RICHARD WARREN was, to his
knowledge, actually inhabiting and cultivating a tract of land on the waters of
Tensaw, on the 20th of December, 1803, and before and after that time, he had
about four acres under cultivation. The plat of above survey above
mentioned enclosed only 500 arpents, equal to about four hundred and
twenty-three acres. No other evidence is addressed.

I, R.L. Deens, assessor of the general tax of said County of Conecuh do hereby then preasance affirm that the within list of Taxable property is as just a list as could be obtained in said County according to the Unorganised situation of said County and the extensiveness of the same. The County is supposed to be one hundered and seventy miles in length and senty in breadeth and but about four known muster Grounds in said County on the last day of July last and they nearly as it were at one end of the County.
